In the past twelve (12) months, our payment processor, Authorize.net, collected the following categories of personal information directly from customers who initiated transactions on our Site:

  • Consumers' full names and billing addresses.
  • Credit and debit card numbers.

In the same timeframe, we disclosed the following information to our marketing firm, TribalVision:

  • Consumers' full names.
  • Consumer's email addresses.

We also disclosed the following information to our email distributor, HubSpot:

  • Consumers' full names.
  • Consumer's email addresses.
8.3.1 Disclosures of Personal Information for a Business Purpose

In the previous twelve (12) months, Company has shared personal identifiers such as names, mailing addresses, and email addresses with MarketDigits Ltd. This was done to fulfill customer orders and for marketing purposes. Company has also disclosed names and email addresses to our marketing firm, TribalVision, and our email distributor, HubSpot, for marketing endeavors. Furthermore, our payment processor, Authorize.net, collected financial information like credit card numbers and billing addresses from customers making purchases on the Site for the sole purpose of completing those transactions.

8.3.2. Sales of Personal Information

In the preceding twelve (12) months, Company has not engaged in the sale of any personal information it has collected.

8.4. Your Rights and Choices

The CCPA grants specific rights to consumers (California residents) concerning their personal information. This section outlines your CCPA rights and provides guidance on how to exercise them.

8.4.1. Access to Specific Information and Data Portability Rights

You have the right to request that we disclose certain details about our collection and utilization of your personal information over the previous twelve (12) months. After we receive and verify your request (as described in Section 8.4.3.), we will provide you with the following information:

  • The categories of personal information we gathered about you.
  • The sources from which we obtained your personal information.

  • If your personal information was sold or disclosed for a business purpose, we will provide two (2) separate lists identifying the categories of personal information each category of recipient purchased (sales) and obtained (disclosures for a business purpose).

It's essential to note that we do not offer these access and data portability rights for business-to-business (“B2B”) personal information.

8.4.2. Deletion Request Rights

You possess the right to request the deletion, deidentification, or aggregation of your personal information that we have collected and retained, subject to specific exceptions. Once we receive and confirm your verifiable consumer request (as outlined in Section 8.4.3.), we will proceed to delete, deidentify, or aggregate your personal information from our records. However, this action may not apply if a statutory exception relating to the data is present.

We may decline your deletion request if retaining the information is necessary for us or our service provider(s) to:

  • Complete a transaction for which we collected the personal information, provide a requested good or service, take actions reasonably expected within our ongoing business relationship with you, fulfill the terms of a written warranty or product recall as required by federal law, or otherwise execute our contract with you.
  • Detect security incidents, safeguard against malicious, deceptive, fraudulent, or illegal activity, or prosecute individuals responsible for such actions.
  • Comply with the California Electronic Communications Privacy Act (Cal. Penal Code § 1546 et. seq.).
  • Enable internal uses aligned with consumer expectations based on your relationship with us.

It's important to note that we do not provide these deletion rights for B2B personal information.

To exercise the access, data portability, and deletion rights detailed above, please initiate a verifiable consumer request by either:

Only you, or an individual legally authorized to act on your behalf, can submit a verifiable consumer request concerning your personal information. You may also make such a request on behalf of your minor child. To appoint an authorized agent, kindly submit a document containing your authorized agent’s full name, contact information, a statement granting the agent access to your personal information or requesting the deletion of your personal information, and your signature to legal@marketdigits.com.

You may make a verifiable consumer request for access or data portability only twice within a twelve (12) month period. The verifiable consumer request must:

  • Provide adequate information enabling us to reasonably confirm your identity as the person for whom we collected personal information or as an authorized representative. This may entail:
    • Completing a two-step authentication process for your MarketDigits account.
    • Submitting evidence of your identity matching two (2) data points already in MarketDigits' possession.
  • Outline your request with enough detail to allow us to comprehend, assess, and address it appropriately.

If we cannot validate your identity or authority to make the request and confirm that the personal information pertains to you, we cannot respond to your request or provide you with personal information. Please note that creating an account with us is not necessary for making a verifiable consumer request. Nonetheless, requests made through your password-protected account will be deemed sufficiently verified when they pertain to personal information associated with that specific account.

We will solely employ personal information supplied in a verifiable consumer request to validate the requestor’s identity or authority for making the request.

For instructions on how to exercise your sale opt-out rights, please refer to Section 8.4.5 below.

8.4.4. Response Timing and Format

We strive to respond to verifiable consumer requests within forty-five (45) days of receiving them. If more time is needed, up to an additional forty-five (45) days, we will notify you of the reason for the extension in writing.

If you have an account with us, we will send our written response to that account. If you do not have an account with us, you can choose to receive our written response either by U.S. mail or electronically.

Our disclosures will cover only the twelve (12) months preceding the receipt of your verifiable consumer request. If applicable, our response will also clarify why we cannot fulfill a request. For data portability requests, we will provide your personal information in a readily usable format, such as a downloadable .pdf or .csv file, allowing you to transmit the information smoothly from one entity to another.

We do not impose a fee for processing or responding to your verifiable consumer request, unless the request is excessive, repetitive, or clearly unfounded. If we determine that a fee is warranted, we will explain the reasons for this decision and provide a cost estimate before proceeding with your request.

8.4.5. Personal Information Sales Opt-Out and Opt-In Rights

If you are sixteen (16) years of age or older, you have the option to instruct us not to sell your personal information at any time (the “right to opt-out”). We do not sell the personal information of consumers we know are under sixteen (16) years of age unless we receive affirmative consent (the “right to opt-in”) from either the consumer aged thirteen (13) to less than sixteen (16), or the parent or guardian of a consumer younger than thirteen (13). Consumers who have opted in to the sale of personal information may opt out of future sales whenever they choose.

To exercise the right to opt-out, you (or your authorized representative) can send a written request to opt-out of your information being sold to legal@marketdigits.com.

Upon submitting an opt-out request, we will wait at least twelve (12) months before requesting your authorization again to sell your personal information. However, you can change your mind and opt back in to personal information sales anytime by submitting a written request to opt back in to legal@marketdigits.com.

You do not need to create an account with us to exercise your right to opt-out. Any personal information provided in an opt-out request will be used solely to process and comply with the request.

8.5. Nondiscrimination

We are committed to not treating you unfairly for exercising your CCPA rights. As outlined in the CCPA, we will not:

  • Refuse to provide you with products or services.
  • Apply different prices or rates for products or services, including offering discounts or penalties.
  • Offer you varying levels or qualities of products or services.
  • Imply that you might receive different prices or rates for products or services or differing levels or qualities of products or services.
9. Call Recording

MarketDigits Inc. records all outgoing and incoming calls for the purpose of training and development, as well as effective client requirement assessment. All recorded calls are treated with the utmost confidentiality. If you prefer that we delete call recordings or refrain from recording calls altogether, please notify us via email or during a phone call with any MarketDigits Inc. representative.
